1. Service Agreement

By using SimuFix Kenya services, you agree to be bound by these Terms & Conditions. SimuFix Kenya provides electronics repair services in Nairobi, Kenya. All repairs are carried out at the customer's request and risk.

2. Liability Limitation

SimuFix Kenya's liability for any repair service is limited to the amount paid for that repair. We are not responsible for:

  • Data loss during repairs (customers must backup data)
  • Damage caused by improper use after repair
  • Devices damaged due to manufacturing defects
  • Loss of business, profits, or anticipated revenue
  • Indirect or consequential damages

3. Data & Privacy

Customers are responsible for backing up all data before repair. SimuFix Kenya technicians may need to access device functions to diagnose issues. We do not intentionally access, copy, or retain personal data. However, we are not liable for any data loss that occurs during the repair process.

4. Payment Terms

Deposit: A 50% deposit is required for repairs exceeding KES 10,000. This deposit is non-refundable if the customer declines the repair after diagnosis.

Diagnostic Fee: A KES 1,000 diagnostic fee applies if you decline the repair after assessment. This fee is waived if you proceed with repairs.

Payment Methods: M-Pesa, Visa, Mastercard, and bank transfers accepted. Corporate clients receive Net 30 invoicing.

5. Warranty

SimuFix Kenya provides a 30-day warranty on parts and labor for all completed repairs, covering:

  • Defects in replacement parts
  • Labor performed during repair
  • Functionality issues directly caused by the repair

Warranty is void if: Device is opened by third parties, liquid damage occurs post-repair, or damage results from misuse.

6. Device Ownership & Collection

Device Retention: Devices unclaimed for 90 days after repair completion become the property of SimuFix Kenya. Attempts to contact the customer via phone and email will be made before this action.

Late Collection Fee: KES 200 per day is charged for devices not collected within 14 days of repair completion.

Liability: SimuFix Kenya is not liable for devices left in our custody beyond 90 days.

7. Parts & Repairs

SimuFix Kenya reserves the right to use genuine original parts or high-quality aftermarket parts of equal or greater quality. We may substitute parts with customer approval. All replacement parts have a minimum 30-day warranty.

8. Exclusions & Restrictions

SimuFix Kenya may refuse service for:

  • Devices with tampered or removed serial numbers
  • Stolen devices or devices with unpaid contracts
  • Devices requiring specialized software (unlicensed software)
  • Repairs that violate manufacturer warranties or local laws

9. Pick-up & Delivery

Free pickup and delivery in CBD. Zone-based pricing applies to other areas (KES 300-500). SimuFix Kenya is not liable for device damage during transport by third-party courier services.

10. No-Fix, No-Pay Promise

If SimuFix Kenya cannot repair your device, you only pay the KES 1,000 diagnostic fee. The device is returned in its original condition, and the customer can seek repair elsewhere at no further cost.

11. Third-Party Software

If a third party has opened your device or installed unauthorized software, SimuFix Kenya may charge additional fees for diagnosis and correction. Warranty may be voided in such cases.

12. Dispute Resolution

Any disputes arising from these terms shall be governed by the laws of Kenya. Disputes will be resolved through negotiation. If unresolved within 30 days, either party may seek resolution through the courts of Kenya.

13. Changes to Terms

SimuFix Kenya reserves the right to modify these terms at any time. Changes will be effective immediately upon posting. Continued use of services constitutes acceptance of updated terms.
